Supreme Court Passport Policy Ruling (November 6, 2025)

The Supreme Court allowed enforcement of a policy requiring that U.S. passports display the sex a

person was assigned at birth. This effectively removed the option for transgender and nonbinary

individuals to select self-identified gender markers such as “X.” The decision framed sex-at-birth as a

“historical fact.” Three justices dissented, warning that the change increases risks of harm and

misidentification.

ACLU Legislative Tracking

As of late 2025, the ACLU reports tracking more than 580 anti-LGBTQ bills across U.S. states. These

bills target various areas, including gender-affirming healthcare, education, identity documents, and

public accommodations. In 2024, over 600 similar bills were filed, marking a record year for anti-trans

legislation.
